I have received a postal requisition and I was not the driver, what do I do?

Often defendants do not understand the offence and state they were not the driver or provide driver details.

A S172 fail to give driver information offence arising from S172(3) of the Road Traffic Act 1988, is not a request for driver information in respect of a road traffic offence.

It is an offence arising from the original offence where information has been requested, by the Police under S172 of the Road Traffic Act 1988, but where this information has not been provided within 28 days. The failure to complete and return a S172 request means that the addressee may be liable for 6 penalty points and a maximum fine of £1,000.
